Covered services may be used only for sending mails or messages to persons from whom you have an express permission to send mails or messages on the subject of such mail or message, such as permission-based email marketing. We are very serious about our anti-spam policy. If we discover that you are sending emails or messages to people without their permission, we reserve the right to terminate your user account. /span>
We know spam is a serious issue.
That’s why our License Agreement and Acceptable Use Policy prohibit all users of our Software Services from sending unsolicited email. Users are required to obtain permission from all recipients before sending mail and honor all unsubscribe requests as quickly as possible.
Sending mail to contacts acquired by any of the following methods is expressly prohibited:
Purchasing or renting from a vendor or other third party
Harvesting or “scraping” from websites or discussion forums
Using data published by the government of a country, state, or locality (e.g. information required to be provided by the US Freedom of Information Act)
Any other method in which the recipient does not provide permission to the sender
Higher Logic reserves the right to terminate service for any user who violates this policy.
What if you receive unwanted mail from a Higher Logic user?
If you never requested the mail, please forward it to info@admarkconcepts.com for review by our Abuse team. If the message is not available, please include as many details as possible about the message sender and content. Each report is investigated fully, and our team will ensure you no longer receive the unsolicited mail.
If you opted in but wish to unsubscribe, click the unsubscribe link in the message you received. If you are unable to do this, please contact the organization or company that sent the email.
For the purpose of this policy
By “permission” we mean express and provable permission granted to you. A permission to send commercial emails may be through
Submission of email address as part of downloading anything from your website or ordering a product or service from you.
Subscription to an email newsletter by filling a form on your website.
Someone has provided you with the email address as part of participation in any contest, event or survey conducted by you and you have informed him/her that you would be sending them marketing emails.
Any instance where a person completing a form has checked an opt-in checkbox indicating their willingness to be contacted by you through email, provided the checkbox is unchecked by default and you have informed such person that the nature of the emails will be commercial.
Any business card given by a person who has expressed his/her willingness to receive emails of a commercial nature. Willingness to receive emails of a commercial nature will be presumed where the business card was dropped in your booth at a tradeshow.
The rule of thumb is “do not use covered services to send mails or messages to email addresses to which you do not have express permission to send emails on the subject of the email.” We insist on 100% compliance with the above rule.
When we say 100%, we do not include those instances where the recipient of an email has marked it as Spam although you have an express provable permission to send emails to that email address. It should be borne in mind that a permission once granted is deemed to have been revoked if the recipient of a mail has opted out of receiving emails from you.
Users must not use covered services to store, copy, send, relay or distribute spam.
In the unlikely event that you receive any message from us or sent using our systems that may be considered to be spam, please contact us using the details below and the matter will be investigated.
In particular, you shall strictly comply with the following rules, which clarify the rule of thumb mentioned above
You should have explicit permission to contact the recipient on the subject of your email. You shall maintain sufficient proof of the fact that you have received permission from all recipients of emails sent by you through covered services.
You shall not import or send emails to email addresses that you have bought, loaned, rented or in any way acquired from a third party, irrespective of any claim about quality or permission, while using Covered Services. You shall also refrain from importing into your Covered Services account or sending mails to email addresses you have collected from other websites.
You shall ensure that the routing and header information including your emails “From” and “To,” the originating domain name and email address are true and accurate.
You shall not use subject lines that mislead the recipient about the contents or subject matter of the message.
You shall provide a one-click unsubscribe option in all emails and refrain from sending emails to persons who have opted out or un-subscribed from your mailing list. The request to opt-out from the mailing list should be honoured within 10 days from the date of request.
You shall include your valid physical postal address in all emails sent through covered services.
You shall include a conspicuous notice in all marketing emails that the message is an advertisement or solicitation and that the recipient can opt out of receiving more commercial emails from you.
We may, at any time, require you to prove that you have express permission to send emails to email addresses you have imported to your Covered Services irrespective of whether you have sent marketing emails to such email addresses.
Your use of covered services signifies your unconditional acceptance of this AntiSpam Policy. We may amend this policy at any time by publishing a new version on our website.
Subscriptions
Mailing list subscribers must specifically opt-into the list they are subscribed to. This applies to both new subscriptions and the bulk addition of addresses already subscribed via other means. Confirmation is handled using a single confirmation message sent to the subscriber's email address. This mailing must contain a URL to the site's privacy policy, a brief description of the mailing list, and a URL that the user must follow to confirm the subscription.
Mailing list subscriber information must include the date and time that the subscription was confirmed, as well as the IP address of the subscriber at the time of the confirmation. The user must be able to present this information at Admark Concepts's request.
The nature of email address use must be fully disclosed, either on the page the subscription is made from or with a prominent link to the site's Privacy Policy. It must be made reasonably clear how a user's email address will be used and in what circumstances it will be shared.
Lists cannot be procured from outside parties unless the email sender has procured a list from an organization that sells or otherwise shares email distribution lists, and all of the following conditions are met:
The selling organization maintains a publicly viewable privacy policy disclosing that such sales may occur.
The privacy policy is prominently linked to from the page the subscriber signed up from.
The privacy policy has not changed substantially since the user signed up.
Records are kept of the date, time, IP address, and form location where the subscribing user signed up from.
Lists procured from outside parties must have been consistently handled in a manner comparable to Admark Concepts policies.
Users cannot populate lists with addresses obtained for a substantially different purpose than was originally disclosed to the user.
All subscriptions must be re-confirmed in the manner described in Subscriptions (Section 1) before being sent bulk email messages.
Mailing
Users must not modify the headers of any message in such a way that purposefully obfuscates the origin of the message.
Undeliverable addresses must be removed from all future mailings after no more than 5 bounces.
Users are responsible for the Admark Concepts of any affiliate program members they solicit the help of, as if they were hiring an outside advertising agency.
Users using either outside advertising companies or 3rd party mailing programs must abide by the same policies and Admark Concepts as those using Admark Concepts's own bulk mailing list tools.
All mailings must provide clear and simple to follow instructions for opting-out of future mailings, and all reasonable attempts must be made to facilitate the removal of a mailing list subscriber at their request.
Spamware
It is strictly prohibited in conjunction with your DreamHost account to sell software designed specifically to facilitate the practice of spamming.
Other
Predominately promotional messages must not be posted to bulletin boards, discussion forums, guestbooks, Usenet newsgroups, or any other similar service unless the operator of that service explicitly allows such messages. In the case of Usenet newsgroups, such messages must be specifically allowed in that group's charter.
Disablement
DreamHost reserves the right to disable any account at any time should it feel there is a reasonable suspicion that it is being used in conjunction with the practice of spamming.
The number of email addresses that can be created in conjunction with any account may be limited, at DreamHost's sole discretion, pending review and verification of compliance with all agreed upon terms.
Customers must substantially address all spam related inquiries by DreamHost personnel within 72 hours. Failure to respond within a reasonable period of time may result in the disablement of the user's account.
